1. About this policy
This policy explains how Juhll, Inc., doing business as Juhll AI Film Studio (a California corporation) ("the Studio", "we", "us" or "our"), handles claims that material on juhll.com (the "Site") infringes someone's copyright. It is part of our Terms of Service. Section 7 of the Terms explains how copyright applies to AI-generated material, and Section 13 covers the Site's own content.
2. Respect for rights
We respect the intellectual property of others and expect the same of everyone who uses the Site. The Site does not host material uploaded by the public. Files that clients upload through private client pages are kept for that client's project only and are not published on the Site.
3. How to send a notice
If you believe material on the Site infringes a copyright you own or control, send a written notice to our designated agent (Section 6) that includes:
- (a) your physical or electronic signature;
- (b) a description of the copyrighted work you believe has been infringed;
- (c) a description of the material you believe is infringing and where it is on the Site (the page URL, and the film or image);
- (d) your name, mailing address, telephone number and email address;
- (e) a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- (f) a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
Notices that leave out these items may not be valid under 17 U.S.C. § 512(c)(3). Knowingly false claims can create liability for damages under 17 U.S.C. § 512(f).
4. What we do when we receive a valid notice
We review each notice promptly. If it is valid, we will remove or disable access to the material and, where we can identify one, tell the person or client who provided it. Where client work is involved, we may also contact the client.
5. Counter-notice
If material you provided was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to our designated agent with:
- (a) your physical or electronic signature;
- (b) a description of the material that was removed and where it appeared before removal;
- (c) a statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
- (d) your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which the Studio may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.
We will forward the counter-notice to the person who sent the original notice. If that person does not tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days after we received the counter-notice.
